Ben is an experienced litigation advisor offering expert guidance in all facets of commercial disputes. His extensive experience covers a range of disputes including property and leasing disputes, franchising disputes, shareholder and partnership disputes, insolvency, employment disputes and investigations, administrative law matters, judicial review, as well as appellate matters.

Ben’s experience includes:

  • Handling complex court cases in state Supreme and District Courts, and appearing as advocate in trial and contested applications.
  • Managing complex adjudications where significant expert evidence is needed.
  • Enforcement of securities including sale of property as mortgagee in possession and the realization of assets secured by the Personal Property Securities Register.
  • Helping resolve commercial disputes in shareholder, sale agreement and franchise agreement disputes.
  • Addressing commercial property disputes under leases and sales agreements.
  • Overseeing workplace and employee investigations, and advising employers on their responsibilities to contractors and employees, as well as appearing before Commissions and Courts as a representative.
  • Advising on competition and consumer law, including product liability and misleading and deceptive conduct claims under the Australian Consumer Law.
  • Advising on competition law, including third line forcing and anti-competitive behavior.
  • Delivering complex guidance to trustees about their responsibilities to beneficiaries.
  • Prosecuting and defending Bankruptcy Proceedings and Winding Up Applications, including proceedings involving foreign judgments.
  • Advising and representing parties in bankruptcy and insolvency proceedings, including the appointment of special purpose liquidators, and bringing and defending claims under the Corporations Act and Bankruptcy Act.
  • Advising on insurance obligations and agreements that deal with significant insurable risks, including third-party liability and incidents involving commercial vehicles.
