Personal Injuries Fact Sheet

Many factors affect your entitlements and obligations if you pursue a personal injury claim.  It is important to be aware of the important factors when dealing with this situation.

Statutory Time Limits

There are statutory time limits that must be observed, otherwise you may lose your right to pursue a claim.

Statutory time limits fall under three regimes:

  1. In the case of a general personal injury claim, the claim must be lodged within one month of seeing a solicitor or within three years of the incident.
  2. In the case of a motor vehicle accident and lodging a claim with an insurer, the claim must be lodged within nine months of the incident.
  3. In the case of a claim arising from a work-related incident, the claim must be lodged within three years of the incident.

 Legislation

The legislative regimes pertaining to general personal injury claims, WorkCover and motor vehicle accident claims are complicated.
